These Terms and Conditions ("Terms") govern your use of folio, an iOS application operated by an individual developer based in California, United States ("we," "us," or "our"). By downloading, installing, or using folio, you agree to be bound by these Terms. If you do not agree, please do not use the app.
We reserve the right to update these Terms at any time. Continued use of the app after changes are posted constitutes your acceptance of the revised Terms.
folio is intended for users who are at least 13 years of age. By using the app, you represent that you meet this age requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.
folio allows you to upload photos and write memory notes ("User Content"). By submitting User Content, you represent that:
You retain ownership of your User Content. By uploading content to folio, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your content solely for the purpose of providing the folio service to you.
If you believe that content on folio infringes your copyright, please send a notice to folio.foraging@gmail.com including: a description of the copyrighted work; the location of the allegedly infringing material; your contact information; a good faith belief statement; and your physical or electronic signature. We will respond promptly to valid DMCA notices.
folio offers optional paid subscription plans that unlock unlimited species identifications. Subscriptions are available on a monthly or annual basis and are processed through Apple's in-app purchase system.
We may offer a free trial period for paid subscriptions. At the end of the trial, your subscription will automatically renew at the applicable price unless cancelled before the trial ends.
folio may offer one-time purchases (such as a lifetime membership). These are non-recurring charges processed through Apple's in-app purchase system.
Your subscription renews automatically unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your Apple ID account settings. Refunds are handled in accordance with Apple's refund policies — we do not issue refunds directly.
We reserve the right to change subscription pricing with reasonable notice. Continued use after a price change takes effect constitutes acceptance of the new price.
All content, features, and functionality of folio — including the app's name, logo, visual design, watercolor portraits generated by the app, UI elements, and trademarks — are the exclusive property of the developer and are protected by applicable intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our app or its content, nor reverse engineer or attempt to extract the source code, without our explicit written permission.
Watercolor portraits generated by folio from your submitted photos are owned by us. You are granted a personal, non-transferable license to save and share these portraits for personal, non-commercial purposes.
From time to time, we may offer promotions, contests, or sweepstakes through folio or our social media channels. Any such promotions will be governed by their own specific rules, which will be made available at the time of the promotion.
If you submit feedback or suggestions to us, you agree that we may use and implement your feedback without any obligation to compensate you or provide credit. You waive any rights you may have in such feedback to the fullest extent permitted by law.

folio is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted or error-free. Species identification results are provided for informational and personal enjoyment purposes only and should not be relied upon for scientific, medical, or safety-critical decisions.
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of folio. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim, or $10, whichever is greater.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California.
We reserve the right to suspend or terminate your access to folio at our sole discretion for conduct that violates these Terms or is harmful to other users, us, or third parties. You may stop using folio at any time and request account deletion by contacting folio.foraging@gmail.com.
